Under the Act, Ofcom serves as the statutory regulator, tasked with developing Codes of Practice and conducting compliance audits. The OSA extends its reach beyond social media and video-sharing platforms to include search services—defined as tools that process queries to retrieve or generate information (Ofcom, 2024). Consequently, ChatGPT and similar systems could be treated as search services, thereby obligating their developers to undertake Children’s Risk Assessments and apply Children’s Safety Codes of Practice by July 2025 (Ofcom, 2025).
4. Ofcom’s Powers and Enforcement Capacity
Ofcom’s authority under the OSA includes:

Therefore, while the legal framework empowers Ofcom to act, the practical question remains whether it will enforce these duties robustly against emergent AI systems, whose data pipelines and prompt behaviours differ significantly from conventional platforms.
5. Discussion: Balancing Innovation and Protection
Baroness Berger’s intervention embodies the growing ethical debate around AI governance—the balance between technological innovation and human welfare (Binns, 2023). Generative AI systems like ChatGPT are not inherently designed for medical or psychological advice, yet their linguistic realism can mislead vulnerable users into treating outputs as authoritative.
If such systems reproduce or generate content perceived as self-harm guidance, even inadvertently, they contravene both ethical research standards and statutory safety obligations. This aligns with the moral argument advanced by Creswell (2018) that researchers—and, by extension, AI developers—carry a duty of care to minimize harm and foresee consequences of their designs.
